CONDITIONS OF EMPLOYMENT

These Terms and Conditions regulate the contractual relationship for the purchase of products offered by ALEA COSMETICS in its online hair care products shop.

The sale of Products through this website is carried out by COSMETICS MYSALON, S.A., (hereinafter also referred to as the "Seller"), a company duly constituted in accordance with the laws of the Kingdom of Spain, with CIF number A65619959 and registered office at Avenida del Vallès, nº 32, Polígono Industrial Cantallops, Llissá de Vall, 08185 Barcelona, Kingdom of Spain.

Use of the website confers the status of user of the ALEA COSMETICS website (hereinafter, the "User") and expresses the User's full and unreserved agreement to each and every one of the Terms and Conditions, with respect to the version published by ALEA COSMETICS at the time the User accesses the ALEA COSMETICS website, as these may undergo modifications. Therefore, the User must carefully read the contents of these Terms and Conditions each time he/she intends to use the ALEA COSMETICS website. In any case, the Terms and Conditions that were posted on the website www.aleacosmetics.com at the time the Client makes use of the services provided by ALEA COSMETICS through the aleacosmetics.com website shall be considered valid and applicable.

The following is the identification data of the service providers, by virtue of the obligation to provide information in article 10 of Law 34/2002, of 11 July, on information society services and electronic commerce:

ALEA COSMETIC is owned by the VMV Cosmetic Group, which is made up of a group of companies including its parent company Holpindus, SL, with tax identification number B61416798 and registered office in the municipality of Lliçà de Vall (Barcelona - 08185), Polígono Industrial Cantallops, Calle Garraf, number 4, which is the main responsible party for the purposes of data protection regulations.

ENTRY INTO FORCE

. Access to and/or use of such services and content expresses the User's full and unconditional acceptance of the Terms and Conditions in the version published by ALEA COSMETIC on its ALEA COSMETIC website at the time of such access and/or use.

. The User declares to be of legal age and to have sufficient legal capacity to be bound by these Terms and Conditions and to have read and understood their contents. Likewise, he/she expressly accepts, without exception, that access to and use of this website and its contents takes place under his/her sole and exclusive responsibility.

. The entire recruitment process shall be conducted in the Spanish language.

OBJECT
This document regulates the contracting of products and/or services offered by ALEA COSMETIC through its Online Shop in exchange for an economic benefit, constituting the basic document that will regulate the contractual relationship between the parties. Therefore, if the user is not completely sure that he/she understands and/or accepts it, please do not tick the acceptance box.

HOW TO PLACE AN ORDER
. The Customer must be at least 18 years of age at the time of placing the order for the order to be valid.

. The product purchase procedure is carried out entirely electronically via the Provider's website.

. The purchase steps are visible throughout the entire procedure. The user must select the purchase process will start when the user selects the product/products he/she wishes to purchase and presses the "Add to cart" button.

. The Customer must complete the entire purchase process and make the payment through the payment system provided by the website.

. When the Customer places his order, we will send him, via e-mail, notification of the completion of the purchase as well as an order identification number.

. If we accept your order, we will notify the Customer of our acceptance by issuing an order confirmation. We will send your order confirmation to you by email, provided that you have provided us with your email address in the personal data form. If we are unable to accept the order, we will contact the Customer to inform them by any of the means that the Customer has provided as a means of contact in their order.

Although we will make every effort to supply the products ordered by the Customer, there may be cases in which it is impossible for us to supply such products due, for example, to the fact that the products are not in stock. In such cases, ALEA COSMETIC will contact the Customer to inform them of the situation and offer alternatives that may be of interest to them. If you do not accept the recommendations, we will cancel your order in relation to the products that we cannot supply and we will refund the amount equivalent to the price of said products. The refund of these sums of money will be the limit of our liability to you in the event that we are unable to supply you with the products ordered. Very occasionally, the prices of the products shown in our Online Shops may be incorrectly specified and show a lower price than the corresponding price due to an error. When the Customer is in this situation, and always in the event that the order has been confirmed by ALEA COSMETIC, we will contact the Customer immediately in order to issue a new order confirmation with the correct price. In the event that the correct price is much higher than the price shown on the website, the Customer shall have the right to cancel the order and we shall refund the amount already paid.

ALEA COSMETIC's priority is the satisfaction of its customers and it aims to achieve this through impeccable service. For this reason, it guarantees the quality of the products delivered and the supply of the same under the terms set out below.

PRODUCT INFORMATION
For ALEA COSMETIC it is important for the customer to know what they are buying at all times. For this reason, we pay great attention to the characteristics of the products, preparing complete technical descriptions, list of ingredients, method of application, as well as a list of their benefits for the hair.

PRICE OF PRODUCTS
. The price of each product shall be clearly specified in its description. The price and conditions of the products offered may vary, but in any case the price and conditions that existed when the order was placed shall always apply to the Customer.

. We reserve the right to charge the order as soon as we receive it.

. All prices are shown including VAT.

. Shipping costs (€6) are not included in the price of the products. The shipping service costs are borne by the Customer and will be added to the total amount of the products selected in the purchase summary step. You will be informed of these costs before confirming the order and finalising the order process. For purchases over 25 € the shipping costs will be free of charge. We remind the customer that ALEA COSMETIC only delivers to the Iberian Peninsula, excluding the Balearic Islands, Canary Islands, Ceuta and Melilla.

. We reserve the right to change our prices at any time. However, we undertake to apply the rates in force on the website at the time the order is placed by the Customer.

PAYMENT SYSTEM

. ALEA COSMETIC works with Banco Santander to guarantee maximum security for payments in our Online Shop. When you see the Banco Santander symbol, you can consider that your transaction is 100% protected.

. ALEA COSMETIC reserves the right to cancel the transaction if our Security Department suspects any anomaly or fraud in the purchase of the products offered in the Online Shop.

. ALEA COSMETIC offers the Customer 1 payment method:

Payment by credit/debit card:
If you choose to pay by credit card, the Customer's order cannot be taken into account and will not be processed until the payment has been authorised by your bank or cashier. Online payment by credit card is carried out via the "Secure Socket Layer" security system, which encrypts your bank details when they are transmitted over the Internet. For security reasons, ALEA COSMETIC verifies all orders paid by credit card. We accept Visa and MasterCard cards registered in the Verified by Visa secure payment system. In addition, for any order, payment may be processed through the 3-D Secure system, through which an SMS is sent to the Customer with a code to be entered during the payment process in order to verify their identity.

. Once the purchase has been made, the corresponding invoice will be issued. Both will include a breakdown of Value Added Tax, if applicable, and shipping costs.

CUSTOMER PRIVACY

. All data provided by ALEA COSMETIC customers will be treated with the utmost privacy and will not be passed on to third parties, except when necessary for the delivery of the order.

. Bank details are processed directly by Banco Santander, the provider we have chosen for the electronic payment service. For this reason, ALEA COSMETIC will never see the customer's credit card information, but will simply receive the payment and the details related to the order in order to process and deliver it. . We reserve the right to use commercial data in an anonymous form to study purchasing habits and usage.

SHIPPING
. ALEA COSMETIC ships the products purchased through the Online Shop to customers residing in the Iberian Peninsula, except the Balearic Islands, Canary Islands, Ceuta and Melilla.

. The shipping costs for the purchase made are €6. On the website, specifically in the shopping basket, the amount of the shipping costs is indicated before the purchase is made.

. Shipping on purchases over 25 € will be free of charge. This will be specified and will be selected, by default, in the summary of the purchase.

. ALEA COSMETIC will ship the products in sealed boxes with a security seal.

. We will send the products to the Customer to the delivery address indicated in the personal data form filled in by the Customer.

. If the desired item is in stock at the time the order is placed, the period between placing the order and the delivery date will be 3 working days (excluding Saturdays, Sundays and public holidays), counting from our validation of the payment received. In this respect, orders placed after 12.00 noon will be processed the following day. In other words, for orders placed between 00.00 and 11.59 (midday), the period for revocation or modification of the order will end at 12.00 noon on the same day. If the order is placed after 15.00 hours, the revocation or modification period will end at 12.00 hours the following day.
If the item is not in stock at the time of placing the order and is not expressly specified in the Online Shop, we will contact the Customer personally to inform him/her of the situation and offer suitable alternatives.

. If, for any reason attributable to ALEA COSMETIC, the aforementioned period is exceeded, we will inform the Client of the incident and will propose alternative solutions.

. We will deliver the product once we have verified that the payment has been correctly executed.

. For his part, the Customer undertakes to ensure that he or another designated person is at the address indicated to receive the parcel. If the Customer is not present the first time, the carrier will insist once again the following day. If the Customer has not received the package within 3 days, he/she should contact ALEA COSMETIC by e-mail (info@aleacosmetic.com) or by calling 93 860 81 11 so that we can make the necessary arrangements.

WARRANTIES AND CLAIMS
All products offered in the ALEA COSMETIC Online Shop meet the quality standards set by the European Union in the production of cosmetic products. All products offered are original products of the brand and, in principle, free of defects. In the event of detecting any type of defect, the Client should contact our Customer Service Department by e-mail at info@aleacosmetic.com, or by telephone on 93 860 81 11. If the defect is found to be true, we undertake to replace it with a new one or make the corresponding payment within 14 days of delivery. In this case, ALEA COSMETIC shall bear all the costs of returning the product and sending the new or repaired product.

RIGHT OF WITHDRAWAL

At ALEA COSMETIC we understand that sometimes the product you receive is not what you expected. For this reason, we have designed a flexible returns policy to ensure that the experience in our Online Shop is as satisfactory as possible. Although the products purchased by the Customer are received by him/her in perfect condition, if the Customer is not satisfied with any of them, he/she can exchange or return them. In the event that they are returned, the Customer will receive a refund of the price of the products within 14 working days of receipt of the returned products by ALEA COSMETIC. In the event that you wish to exchange them, you must pay the difference if the price of the returned product is lower than the new one. If, on the other hand, the returned product is more expensive than the new one, ALEA COSMETIC undertakes to reimburse the difference within 14 days. In any case, the Customer shall be responsible for the return shipping costs. In addition, for the return to be accepted by ALEA COSMETIC, the following conditions must be met:

. Products must be returned within 14 working days from the date of receipt of the order by the Customer.
. The Client must notify ALEA COSMETIC of their wish to return the product by sending an email to info@aleacosmetic.com. If this prior notification is not made, it will not be possible to process the return.

. ALEA COSMETIC will not accept the return of the product when it shows obvious signs of having been used.

. To carry out the return it will be necessary that the product is delivered with the packaging in perfect condition, that the product and its accessories are in perfect condition, as well as that the product is packaged in such a way that it is not possible for it to deteriorate during transport.

. On the other hand, if the Customer receives damaged or defective products, ALEA COSMETIC shall bear the cost of returning the order. In these cases, the Customer may choose between receiving a full refund of their order (which will be carried out within 14 working days from the date of receipt of the order), receiving the same product again (within 72 hours) or exchanging it for another product. In the latter case, the Customer must pay the difference if the price of the returned product is lower than the new one. If, on the other hand, the returned product is more expensive than the new one, ALEA COSMETIC will reimburse the difference within 14 days. In any case, whether the Customer decides to receive the same product again or to exchange it for another, ALEA COSMETIC shall also bear the shipping costs of this new delivery.

OBLIGATIONS OF ALEA COSMETIC AND THE CUSTOMER

. ALEA COSMETIC undertakes to provide the Customer with all the necessary information relating to the products offered in its Online Shop, as well as orders. ALEA COSMETIC shall not be held liable for failure to comply with these conditions in the event of force majeure or an unforeseeable event, either on the part of the Client or a person outside the contract.

. The Customer undertakes to fill in the order forms and their fields according to the instructions indicated and with truthful information. ALEA COSMETIC will protect the data in accordance with the law. The Customer also undertakes to pay the price of the product, with the corresponding taxes and shipping costs.

. ALEA COSMETIC shall not be liable for any loss of data, files or, in general, for any damage resulting from a failure by the Customer to back up the data contained in the products purchased. We therefore recommend that you keep a copy of the data contained in the products purchased.

. ALEA COSMETIC cannot be held responsible for any consequences that may result from the improper use of the products sold in its Online Shop.

COMMENTS
Although we respect your opinions, all comments posted on the website and social networks will be monitored by the marketing team. If the opinions received infringe the law, ethics or morals (abusive advertising, defamation, insults, comments out of context...), we at ALEA COSMETIC reserve the right to reject or modify such opinions.

INTELLECTUAL PROPERTY
The content of the ALEA COSMETIC Online Shop and its Trends blog (illustrations, texts, icons, images and videos) is the property of ALEA COSMETIC. Any partial or total reproduction of the content by any process and on any medium whatsoever is subject to prior express authorisation from ALEA COSMETIC.

MODIFICATION OF THE GENERAL CONDITIONS
ALEA COSMETIC reserves the right to modify, at any time and without prior notice, the presentation and configuration of the website, as well as the General Conditions of Use. The Client will always have these General Conditions in a visible place, freely accessible for any queries they may wish to make. The Client must read these General Conditions of Use carefully each time they access the website. In any case, the acceptance of the General Conditions of Use will be a prior and indispensable step to contracting any service available through the website.

APPLICABLE LAW AND JURISDICTION
. All litigious matters or those concerning these general contracting conditions hosted at www.aleacosmetic.com shall be interpreted and governed in accordance with current Spanish and European legislation.

CONFLICT RESOLUTION
. Any disputes that may arise between the consumer and ALEA COSMETIC as a result of a breach of the contract conditions shall be governed by the provisions of current legislation, with the rules of the Spanish legal system being applicable.

. If any provision of these terms is held to be invalid or unenforceable, such provision shall be deemed severable and shall not affect the validity of the remaining provisions.
